Review the terms and conditions for Somerhaus event venue services and website use.

These Terms of Service ("Terms") govern your use of Somerhaus venue services and website. By booking our venue, signing an event agreement, or using our website, you agree to these Terms and acknowledge that you have the authority to do so.

1. Venue Services

Booking and Reservations

  • All venue bookings require a signed contract and deposit
  • Dates are held for 72 hours pending contract execution
  • A detailed event timeline and vendor list are due 30 days prior to your event
  • Final guest count must be confirmed 7 days prior to event
  • All deliveries and pickups must be coordinated within the contracted rental window
  • Setup and breakdown times are specified in your contract
  • Events must end by the time specified in your agreement

Payment Terms

  • 50% deposit required to secure your date
  • Accepted payment methods include credit card, ACH, or check unless otherwise agreed in writing
  • Final payment due 7 days before your event
  • Additional charges for overtime, damages, or requested add-ons apply and will be invoiced after the event
  • Refunds are processed within 30 days and subject to our cancellation policy

2. Cancellation and Refunds

  • Cancellations more than 120 days before event: 50% deposit refund minus non-refundable planning fees, if applicable
  • Cancellations 60-120 days before event: 25% deposit refund or application toward a new date within 12 months
  • Cancellations less than 60 days before event: No refund
  • Date changes subject to availability and may incur administrative and price-difference fees
  • Force majeure events handled case-by-case in accordance with Section 12

3. Venue Use and Conduct

Permitted Use

  • Venue may only be used for pre-approved events
  • Maximum occupancy limits must be observed
  • All activities must comply with local laws and regulations
  • Decor installations must be approved in advance and use non-damaging materials
  • Smoking is prohibited inside the venue

Prohibited Activities

  • Illegal activities of any kind
  • Excessive noise after specified hours
  • Damage to property or fixtures
  • Unauthorized vendors or catering
  • Use of glitter, confetti, open flames, or pyrotechnics without prior written approval

4. Liability and Insurance

  • Event hosts are responsible for guest behavior and any damages
  • General liability insurance may be required for certain events
  • Certificates of insurance must be provided at least 14 days before the event date
  • Somerhaus is not liable for personal injury or property loss except as required by law
  • Security deposits may be required and are refundable barring damages
  • All vendors must provide proof of insurance

5. Indemnification

You agree to indemnify and hold Somerhaus, its owners, and staff harmless from claims, damages, liabilities, costs, and expenses arising out of or related to your event, your guests, or your breach of these Terms.

6. Website Terms

Acceptable Use

  • Website content is for informational purposes only
  • You may not use our content without permission
  • Automated scraping or data collection is prohibited
  • False or misleading information in inquiries is prohibited

Intellectual Property

  • All website content, images, and branding are our property
  • Trademarks and logos may not be used without permission
  • User-generated content may be used for marketing purposes

7. Privacy and Data

  • Your privacy is governed by our Privacy Policy
  • We collect information necessary to provide our services
  • Data may be shared with vendors involved in your event
  • Marketing communications require opt-in consent

8. Modifications and Updates

  • We may update these Terms at any time
  • Material changes will be communicated to active clients
  • Continued use constitutes acceptance of updated Terms
  • Contract terms supersede website Terms for booked events

9. Governing Law

These Terms are governed by the laws of Ohio. Any disputes will be resolved in the courts of Hamilton County, Ohio.

10. Photography and Media

Unless otherwise agreed in writing, you grant Somerhaus permission to capture and use non‑identifying photos or videos of the event space for marketing and portfolio purposes. If guests are featured prominently, we will obtain appropriate consent when feasible.

11. Alcohol and Catering

Alcohol service must comply with all applicable laws. Licensed bartenders and catering partners may be required. We reserve the right to refuse service to intoxicated guests. Outside alcohol policies must be pre‑approved in writing.

12. Force Majeure

Neither party is liable for delays or failures caused by events beyond reasonable control, including but not limited to acts of God, government orders, public health emergencies, utility failures, or other causes beyond the parties' control. Affected obligations are suspended for the duration of the event.

13. Dispute Resolution

If a dispute arises, the parties agree to first attempt good-faith mediation before pursuing litigation. Each party is responsible for its own costs, and mediation will occur in Cincinnati, Ohio unless otherwise agreed.
